Earlier today, TVXQ / DBSK / Tohoshinki got together on stage to hold a concert at the Hongkou Soccer Stadium in Shanghai, China. Despite the turmoil, rumors of breakup, and lawsuit with SM Entertainment, the boys got together and put on a great show for the more than 30,000 fans in attendance.
According to fan accounts, TVXQ's leader Yunho said: "The five of us will never part!" Even though the concert was held in China, this lead the crowd to chant "믿어요! 동방신기 사랑해" which translates to "Believe! We Love Dong Bang Shin Ki." Jaejoong, and Micky were both seen crying around this time as well. There's also reports that all 5 cried together at the end.

TVXQ’s Endlessly Sweet reaches number 1
TVXQ / DBSK / Tohoshinki's new digital single "Endlessly Sweet" reaches number 1... no, not on the Oricon Charts but on the mu-mo chart.
Endlessly Sweet is a song for TVXQ's "Pinky" (Candies) Commercials that has been airing in Japan. Unfortunately, you won't be seeing the song on the Oricon Chart because there's no physical copy release of the single, instead it was released as a "digital only" single on September 23rd. Mu-mo is basically the Japanese version of iTunes and their music chart is based on downloads. Coming in at number 5 on the mu-mo-chart was Jaejoong's and Micky's "Been So Long" single.
That's not the only chart where "Endlessly Sweet" took first place, the song also took first on the Musico Daily chart. Jaejoong's and Micky's "Been So Long" single faired a bit better here than mu-mo and was right behind "Endlessly Sweet" at number 2 on this chart:

Jaejoong, Yoochun, Junsu Seeking Escape Route?
It was reported recently that the DBSK trio of Jaejoong, Yoochun and Junsu, currently embroiled in a lawsuit against SM Entertainment, have been meeting frequently with tv drama production companies, leading many to speculate about their future plans.
According to sources, since the lawsuit was filed, not only has the DBSK trio been seen in frequent discussions with other entertainment companies, they have also been seeking out suitable properties to act as their new offices, further confirming their desire to split with SM Entertainment.
Many speculate that the DBSK trio are seeking to find an escape route through acting in tv dramas. The trio have time and again stressed that they only want to void their contract with SM but without DBSK disbanding. Even if they win the lawsuit against SM, they wouldn't be able to release an album since Yunho and Changmin did not participate in it. So dramas would be their best alternative.
Despite the being advised that they should solve their differences outside of the court, SM Entertainment and the DBSK trio have been unable to come to a conpromise with each other. The courts will be ruling on the case very soon.

SM Entertainment’s request gets thrown down
On August 5th of 2009, TVXQ's Jaejoong, Yoochun and Junsu demanded that SME show them the full contract terms, income records, and other documents that SME hid from them.
The court took TVXQ's side on that conflict, and ordered SME to provide the related documents in trial.
But, SME insisted that the documents weren't subject to investigation according to Korean civil law and that a specific time frame and type weren't specified.
SME then demanded that TVXQ's request for those documents be refused by the court, only to be rebuffed by the court itself.
The Seoul Central Court stated that, "The documents in question have been created by the artists and their affiliated company about legal matters, and according to civil lawsuit proceedings, the owners of the document have no right to withhold the documents from court nor others involved with the documents. Therefore SME's claim that the documents shouldn't have to go under examination is an unreasonable claim."
So it looks like SM has no more tricks up their sleeves. Now we will all know why SME has been so reluctant to reveal the income records and the contract terms.
The court has ordered that SME provide the documents within 10 days.
Things are heating up, and what seems like this infinitely postponed court ruling will finally be revealed by the end of September.
But don't let it fool you. This is just one trial of many that will spring up from this TVXQ issue.

TVXQ talks with SM Entertainment break down
In the phone conversation, the court stated that it'll be all up to them to come up with the resolution as both sides despite talks of resolution, will not budge from their initial stances. They continued by stating that they're thoroughly reviewing all the papers, documents, and evidence given. After this thorough investigation, both parties will be notified of the decision. The Court stated that they don't know when exactly they'll come up with the decision but that it should be sometime this month.
As the talks have broken down, it seems there's no chance of resolution outside the courts. Hopefully the courts come up with a fair and firm decision. Also check out the ONE-TVXQ Forums.

TVXQ is number 2 in Japan for…
TVXQ / DBSK / Tohoshinki has been very successful in Japan, with numerous number #1 hits on the Oricon Charts and holding concerts at the famed Tokyo Dome. With all these acheivements, The Rising Gods of the East have really risen fast in the land of the rising sun. Well, they can add another title to their long list of feats in Japan.
On September 13th, Japanese CDTV had a poll asking, "What Artists do you want to see most live?" And the boys of TVXQ came in at number 2. They surpassed famous acts such as Kat-tun, Exile, and Ayumi Hamasaki. Only the mega popular Arashi were ahead of them.
I remember not too long ago when TVXQ wasn't even allowed on Music Station, they've come a long way. Congratulations and much continued success in Japan. I also hope the legal issues in Korea are remedied soon. Thanks to kpopper for the tip. Also check out the OneTVXQ Forums.

TVXQ vs. SM Entertainment Final Decision
The legal battle regarding unfair contracts between team TVXQ (Youngwoong Jaejoong, Micky Yoochun, Xiah Junsu) vs. SM Entertainment is slowly coming to an end.
The court had ordered SM Entertainment to turn in all financial documents by September 11th, 2009 (today in Korea). Upon review of these documents, a final decision is to be made.
The court has stated that this will be a final judgment and that both parties will not be returning for a retrial, once a decision is made.
SM Entertainment stated:
"After turning in all documents by the 11th, there is nothing more for us to do than await the courts final decision. As of now, we have no idea when a decision will be made by the courts."

DBSK Fans Want Their Money Back from SM Entertainment
Yes, the fans of DSBK are threatening to sue SM Entertainment if they do not get some of their money back. They had originally brought tickets to the now postponed SM Town Live 2009. 1,222 fans gathered on September 3rd, demanding an apology and at least 10% of the ticket price refunded to them.
SM Entertainment had originally stated that DBSK would attend the concert despite their pending lawsuit with them and the whole show would go on as planned. But at the very last minute, they postponed the show, without a valid reason, leaving many fans hurt, distraught, broke and feeling betrayed by DBSK's parent company.
According to the fans, since SM Entertainment didn't give a good enough valid reason for the postponement, and thus they have got some explaining to do.

TVXQ Rejects Rumors of Disbandment
In the interview, the quintet expressed their excitement for their growing popularity in Japan. Leader Yunho felt that their fan count was increasing; the Tokyo Dome concert was a success and the recent video release has become a hot issue. They also discussed international plans in coming months and rejected rumors of disbandment. "[We hope that] all five members can attend the end of the year music programmes," Yunho expressed during the interview in reference to Kohaku in Japan & Gayo Daejeon / Music Festivals in Korea. Junsu later added, "following this, all five members will continue to do activities together. We want to grow with our fans."
Furthermore, each member, including those involved in the legal dispute, gave a reassuring message to fans:
Changmin: Please be careful not to get too tired this summer.
Yunho: To everyone who couldn’t manage to come this year, let’s enjoy it together with Tohoshinki next year!
Junsu: I want to do many more activities with fans in the future. Please look forward to it.
Jaejoong: I really want to do next year a-nation again really soon. I want to enjoy the stage with these five members again.
Yoochun: We want to perform a lot of songs in the future. We want to sing. That’s all.
Indeed, TVXQ's activities in Japan are still in full swing and there's no indication of major impediments anytime soon. Earlier this month, TVXQ performed in avex's a-nation, their fifth appearance on this annual summer concert tour. Jaejoong and Yoochun, though both involved in the legal controversy, are still scheduled to be featured in M-Flo's 'Been So Long' and to release their own song on the 30th. Yunho is busy filming for Heading to the Ground, and Changmin is filming in his star role for Paradise Meadow.
The fact that group activities are on hold right now for the pursuit of solo activities seems to be unrelated to the lawsuit. "Even if we have these various activities for each member, we'd like to keep rising with everyone, together," Junsu explained. Yunho promised to meet again at next year's a-nation as well.
However, it's not like DBSK is avoiding Korea - in fact, all five members returned to their home country yesterday morning (Aug 31), though there aren't any major schedule plans revealed yet. Furthermore, DBSK will be holding a concert in Shanghai on October 2. With such an ambitious, pan-Asian schedule ahead of them, the rumors of disbandment now seem quite unlikely - fans, take a deep breath! Hopefully everything works out and they come back stronger than before.

Battle of the Acting Idols
This fall, your three favorite idols will be competing in, not music charts, but TV ratings!
Three different idols will be appearing on three different dramas on three different broadcasting companies. I smell a battle of the idols!
◇ MBC - Jung Yunho (Uknow-Yunho) (TVXQ)
As the leader of the five-member pop group TVXQ, Jung Yunho will be appearing as the protagonist on "Heading to the Ground" airing on September 9th after "Hon" finishes. In this drama, he will be acting with Go Ara, and play the role of a passionate soccer player. "Heading to the Ground" will attempt to break the chain of failures of sports-related dramas. My opinion? With an astounding number of dedicated fans, they won't have to worry about ratings. Well, unless it sucks...real bad...like "Dream".
◇ SBS - Kim Heechul (Super Junior)
Kim Heechul will be representing his 13-member group, Super Junior as a supporting actor on "I Love You Ten Million Times". This drama already aired on August 29th. Lee Soo Kyung and Jung Kyo Woon are the main actors. Park Soo Jin will be the other supporting actress, and we expect quite a connection between the current idol (Heechul) and ex-idol (Soo Jin: ex-Sugar).
◇ KBS - T.O.P
We all know much about T.O.P's drama, "Iris" which will air on October 14th. Although T.O.P will only be a supporting actor, the superb main cast including Lee Byung Hun and Kim Tae Hee will sure shine the drama. "Iris" will be the first "spy" drama. T.O.P plays the role of a cold assassin.
More idols on screen:
FT Island's Lee Hong Ki will be appearing on SBS's "You're Beautiful". On the other hand, TVXQ's JaeJoong and Changmin will be appearing on different mini dramas of the "Telecinema Project": JaeJoong on "Heaven's Postman", and Changmin on "Paradise Meadow".
Idols have dominated the music scene, and now they're ready to conquer the drama scene as well. Before we know it, they will take over the world! Wait...I think that's already in progress.

TVXQ fans are very persistent
“The exclusive contract between TVXQ and SM Entertainment is so unlawful and so violating of basic human rights that it is hard to believe that this is the contract between the nation’s best idol group and the nation’s best entertainment agency,” said the fans. “This contract shows the dark, sinister side of the Korean agency and is shocking the nation.”
On July 31st, Jaejoong, Micky and Junsu filed for the Exclusive Contract Validity Suspension and Provisional Disposition Request against SME, and the offline pertition was created in very speedy 6 days from August 12th to the 18th.
The dedicated fans finally commented, “We hope that they will be able to escape from this violation of human rights as quickly as possible and we hope that the National Human Rights Commission of Korea will help us protect the rights of TVXQ.”

TVXQ to suspend group activities
TVXQ will be suspending their group activities pretty soon after completing all their planned schedules. This is largely due to the lawsuit filed by JaeJoong, YooChun and Junsu against SM Entertainment for their slavery contract to be amended.
As spoke in the aftermath of the lawsuit, TVXQ will complete their planned schedules before the lawsuit was filed which will end on 29th August. Beyond that, TVXQ will be taking a "vacation", with regards to group activities, although solo activities will continue.
There are still two live performances for fans to catch TVXQ together as a group before their vacation, the first being A-Nation in Osaka, Japan and their Shanghai concert.
The court has already heard both sides of the story from SM Entertainment and the TVXQ trio (JaeJoong, YooChun and Junsu) earlier. Although the court has advised both parties to sit down and settle their differences, it's kind of unlikely that a solution would be reached at this juncture. The ruling of the case will be decided on 11th September, where fans all over the world would be glued to their computers, hoping that TVXQ will still exist as a group.

Changmin is focused for “Paradise Meadow”
During any free time he gets, while on planes flying back and forth between Japan and Korea, Changmin is always found reading and rehearsing his script. "Truthfully, the recent crisis has began to wear on him... but since acting has been something he has wanted to do for a while, this seems to be a good motivation for him," says his assistant. "He has been showing a lot of excitement in preparing for this drama."

TVXQ Changmin to start filming soon
Star News is reporting that Changmin will officially begin filming for the drama in early September. Which should get some fans (especially Reina) happy. There's no official word yet on when the drama will actually air.
So it seems as Jaejoong, Xiah, and Micky are partaking in one type of drama... with SM Entertainment. While Yunho and Changmin will participate in another type of drama, fans would much prefer the latter.

Lee Minwoo Speaks Up on TVXQ
The singer went on to give TVXQ a message, "My dear younger brothers, TVXQ does not just belong to TVXQ. Don't think too much and over-complicate things; just keep thinking about your fans who have spent precious times with you and who have always protected you. I hope that all of you can steadfastly protect the proud name of TVXQ. You definitely can't disband, Hyung is counting on you. After the current issue is resolved, the 11 of us should go out and have fun."

SM Entertainment to provide crucial evidence in TVXQ case
At 10:20AM KST on August 21st, SME applied for an injunction in rebuttal to providing confidential documents as they should not be released to the public.
SM said, "The process of settlement procedures, materials, and the company's trade secrets cannot be exposed to the media, as they would be fatal for the company."
The courts have however stated that the confidential information will be safe, and that they will only be reviewed by specific individuals and not released to the public.
SM Entertainment will have to submit all documents by September 11th, 2009. And with the release of these documents, TVXQ's payment settlement issues may be resolved.
Meanwhile, at least 120,000 TVXQ fans have signed a petition for TVXQ's "unfair" contract and submitted to the Seoul District Court on the 20th.

TVXQ is upset, but hopes for the best
TVXQ's lawyer stated "TVXQ members are very upset about the entire situation, but hopes that the lawsuit will end well." In addition, "We do not want TVXQ to split up. And even if they do change management companies, there is still a chance that TVXQ will remain together."
SM Entertainment's lawyer stated, "There are no personal grudges against the members, however this lawsuit is an enormous loss to the company, therefore we wish to resolve this as quickly as possible and have TVXQ continue their activities." In addition, SME stated that, "In regards to the members running Chinese based cosmetics businesses, SM only intervened as it could potentially hurt their image. That was the only reason."
The 1 hour and 20 minute hearing over exclusive contract rights and improper compensation is now over, however SM Entertainment is required to submit financial proof and documentation by September 11th, 2009, in order for the courts to make a final judgment.

DBSK breaking up for good?
DBSK's Junsu, Micky, and Jaejoong will have their first hearing regarding their situation with SM Entertainment on the 21st. An appeal to the courts to suspend the exclusive contract between DBSK and SM Entertainment was made (by DBSK) and if by chance the exclusive contract suspension does not go through, the 3 members will leave the group. Furthermore, it is being speculated that the two members who did not partake in the appeal, Yunho and Changmin, will walk a separate path with three new members.
Considering all this, the reactions of the fans will probably cause absolute chaos. Not only this, but people who are vying for the three open spots of DBSK will also be tearing up a storm to get a chance. DBSK's fan club Cassiopeia is currently boycotting SM Entertainment. With the cancellation of SM TOWN LIVE '09, they began the boycott on the 12th and are continuing to do so.
Of course, people are unsure of which way the wind will blow as of yet. Things with SME may be resolved, but the probability of the group breaking up is also quite real.
